Public Libraries
Explanatory Note:
The objective of this part of the Bylaw is to provide for the efficient operation and
management of public libraries for the benefit of the general public.

19.1 SPECIFIC DEFINITIONS
These definitions apply specifically to this part of the Bylaw, in addition to the general definitions in Part 1: General Provisions: |
|
| book | includes a magazine, newspaper, periodical, pamphlet, or manuscript or other article of similar nature, or any part whether it is in written, audio or visual form or transmitted by electronic media. |
| borrower | you or any person who we have registered or otherwise given any licence or privilege to borrow. |
| borrower's card | means any card issued by the librarian as a means of identifying you as a borrower from the library. |
| document | any map, picture, or piece of music including a record, sound recording tape or compact disc, broadsheet, card, cutting, photographic or negative film, electronic document, or photocopy, whether the property of us or for the time being under our control. |
| librarian | includes any person for the time being appointed by us to control or manage (or to assist in the control and management of) the library. |
| library | a library or part of a library established and operated by us for your use, and includes every part of any building used for that purpose, and includes a mobile library. |
| map | includes a chart or plan or other article of a similar nature, and includes any rental picture in any form that is available for hire. |
| 19.2 | ||
| 19.2.1 | Subject to the provisions of this part of the Bylaw relating to subscriptions and charges for the borrowing of documents, the library will be open and available to you free of charge at such times as we decide. |
|
| 19.2.2 | We can vary the hours of operation by closing the library or any part of it for any period that we decide. |

| 19.3 |

| 19.3.1 | Unless you have the permission of the librarian, you must not: |
|
(a) enter or remain in the library except when it is open and available to the public; |
||
(b) consume alcohol in the library, or offer alcohol to any person in the library; |
||
| (c) enter, remain in, or use the library while drunk, or under the influence of drugs; | ||
| (d) lie on any bench, chair, table, or floor in the library or sleep in the library; | ||
| (e) interfere in any way with any other person lawfully using the library; | ||
| (f) while using the library fail to comply with all reasonable requests of any librarian; | ||
| (g) behave in a noisy or offensive manner in any part of the library; | ||
| (h) bring in food or drink, whistle, smoke or use tobacco, or use rude or threatening gestures in any part of the library; | ||
| (i) bring a dog or animal into the library or allow a dog or animal to enter the library unless a librarian has given permission for the dog to come in; | ||
| (j) bring into the library any item which, in the opinion of a librarian or other official of the library, interferes with the use of the library by others, and you must remove the item immediately when asked to do so by a librarian; | ||
| (k) enter any part of the library set apart for the use of the staff without the permission of a librarian; | ||
| (l) use any of the library resources to access offensive or indecent publications, or for illegal purposes. | ||
| (m) damage any book or document belonging to the library; | ||
| (n) make a copy of any book or document belonging to the library without the permission of a librarian, or in breach of the Copyright Act 1994; | ||
| (o) remove any number, label, or mark of ownership from any book or document belonging to the library; | ||
| (p) damage any portion of any library or any furniture or fitting or any property owned by us; | ||
| (q) take any book or document out of any part of the library, without being issued by a librarian; or | ||
| (r) provide incorrect or misleading information when asked to provide identification by a librarian. | ||
| 19.4 |

| 19.4.1 | We may make rules by resolution concerning: |
|
(a) the internal control, management, and use of the library; |
||
| (b) the type and number of books or documents to be lent to any one borrower to be held at one time; | ||
(c) the times and hours during which the library is to open and the holidays, days, and times on which it may be closed; |
||
(d) the hours during which any book or document may be borrowed from any specified portion or department of the library; |
||
(e) the time to be allowed for the return of any book or document; |
||
(f) prescribing fees in regard to fines for breaches of hiring rules of the library; |
||
(g) maintaining good order and conduct within the library; and |
||
(h) setting fees and charges payable by persons using the services of any department of the library. |

| 19.5 |
||
| 19.5.1 | You must not let someone else use your borrower's card in order to obtain any book or document from the library. |

| 19.6 |
||
| 19.6.1 | You are responsible for all items issued on your borrowers card. |
|
| 19.6.2 | You must not take or borrow any book or document from a library without the permission of a librarian. |
|
| 19.6.3 | Even if you hold a borrower's card, you are not entitled to borrow any book or document specified as a reference book or document unless a librarian at his or her discretion allows you to borrow such a book or document, and then only in accordance with any conditions which the librarian specifies. |

| 19.7 |

| 19.7.1 | If any book or document which you borrow is lost or is returned damaged you must pay us a sum of money to replace the book or document or to compensate us fully for any damage or loss. |
|
| 19.l8 |
||
| 19.8.1 | If you owe us more than $2.00 or any other amount in connection with any library, you must not take out or borrow any book or document, and any librarian may impound your borrower's card. |
|
| 19.9 |
||
| 19.9.1 | If you hold a borrower's card you must notify any change in your address to a librarian. |
|
| 19.10 |
||
| 19.10.1 | We may prepare a code of practice giving general guidance and instruction about the operation of this part of the Bylaw, to assist you and our officers in implementing it. The code of practice does not form part of the Bylaw and if there is any difference between the code of practice and the Bylaw, the Bylaw will prevail. |
|
| 19.11 |
||
| 19.11.1 | You must not: |
|
(a) try to take or attempt to take (other than as a borrower) any book, document, or other article from a library, or |
||
| knowingly pledge, pawn, sell, or purchase or advance money on a book, document, or article which you have taken from a library, or try to do so. | ||
| 19.12 |
||
| 19.12.1 | You must leave the library immediately if any librarian asks you to do so, on the grounds of disorderly conduct in the library, or if you are not legitimately using the library for the purpose for which it is intended. |

| 19.13 |
|
|
| 19.13.1 | Where in our opinion you have contravened any of the provisions of this part of the Bylaw relating to the library or have otherwise acted in an unlawful manner in the library, we may ban you from the library, and/or confiscate your borrowers card for a specified period. |
