What is a Compliance Schedule?

A Compliance Schedule (CS) is a document issued by Council for a public and commercial building if it contains any specified systems. If appropriate, a single household unit will require a compliance schedule, if it contains a cable car or is serviced by a cable car (As from 31 March 2008) The CS will contain the systems and features including the inspection, maintenance and reporting procedures needed to keep them in good working order. A Compliance Schedule must be kept on site and made available to Council Officers, IQP’s/Licensed Building Practitioner’s (LBP) and authorised agents.

What is a Compliance Schedule Statement?

A Compliance Schedule Statement (CSS) is issued by Council as a temporary public notification of Compliance Schedule requirements and is to be replaced in 12 months time and every 12 months thereafter by the Building Warrant Of Fitness. The owner must display the said document in a public area within the building.

What is a Building Warrant Of Fitness?

This is a building owners signed statement (on a prescribed form available from Council) that the requirements of the Compliance Schedule have been fully met and it must have attached to it, all of the Certificate Of Compliance (COC) documents, issued by the IQP/ Licensed Building Practitioner, (LBP) in the prescribed forms that, when those certificates are considered together, certify that the inspection, maintenance and reporting procedures stated in the Compliance Schedule, have been fully complied with during the previous 12 months. The BWOF and certificates must be sent to Council and a copy of the BWOF displayed within the public area of the building replacing the CSS. Copies of the COC’s and any maintenance documents are to be retained by the owner for 2 years and made available to authorised persons for inspection when required.

What is an IQP (Independent Qualified Person) / LBP – (Licensed Building Practitioner)?

An IQP/LBP is a tradesperson who is registered or issued with a class of licence relative to a specified system and or feature and is therefore qualified to carry out any performance inspection, maintenance, reporting or recommendation for an amendment to the CS. At present IQP’s are required to be registered with Territorial Authorities. The LBP regime will commence from the 30 November 2009.

A register will be maintained in accordance with the act for the purpose of allowing members of the public to determine wether a person is qualified, choose an appropriate LBP, and how to make contact and to identify which LBP has been disciplined within the last 3 years.

If I want to amend the Compliance Schedule, what do I do?

Providing you are the owner, you will be able to make an application for an amendment at any time in the prescribed form under section.106 Building Act 2004 to ensure the specified systems are performing appropriately and will continue to perform, to the performance standards for those systems. Also a recommendation for an amendment by an IQP/LBP can be submitted with the BWOF in the prescribed form. Council will consider the application and respond appropriately. You may also require a building consent.

How do I obtain a Compliance Schedule?

A CS, will be issued with a Code of Compliance Certificate by a Building Consent Authority (BCA) generally for new buildings if the building has one or more specified systems such as sprinklers, warning systems, ventilation and lifts etc. Any other time will be if you are upgrading the building or systems by consent or a change of use or alterations etc that may also require a consent. However, if you are aware of any systems within your building you will need to make application for the certificate or if unsure, contact Council for advice and an application form.

What happens next?

Ensure to ask your IQP/LBP to provide you with instructions regarding the reporting procedures for the next 12 months required for each system and feature. Remember you are required by law to obtain annual written reports relating to the inspection, maintenance and reporting procedures of the CS signed by each IQP/LBP who carried out 1 or more of those procedures and keep those reports together with the CS for a period of 2 years and produce those reports for inspection when required.

Can I be prosecuted for not obtaining a Compliance Schedule or if my Warrant Of Fitness has expired?

Yes, depending on the alleged offence up $20,000 or a maximum of $200,000.
