Explanatory note: This part of the Bylaw deals with the rules governing public swimming pools, the hiring of halls, and the Takapuna Golf Course.
8.1 Specific definitions
These definitions apply specifically to this part of the Bylaw, in addition to the general definitions in Part 1: General Provisions:
Pool - any swimming pool under our control for use by the public or any section of the public, including any premises used in connection with the pool.
Attendant - any person employed or contracted by us to control or manage or assist in the control and management of any pool.
Course - Takapuna Municipal Golf Course.
Hall - a hall or any part of a hall owned or controlled by us.
8.2 Use of swimming pool
8.2.1 We may pass a resolution or resolutions which:
(a) set the periods during which the pool is open for use;
(b) limit the use of a pool to a particular class or group of people for certain periods of time; and/or
(c) set the charges for entry to the pool.
8.2.2 We may close any pool or any part of it to the public for a period of time for the following reasons:
(a) so that swimming competitions or other sports can be held;
(b) so that the pool or part of the pool can be cleaned or repaired;
(c) if an attendant believes that there is an emergency or other situation which warrants immediate closure of the pool or any part of it. The pool will remain closed until, in the attendant's opinion, the emergency or other situation no longer exists; or
(d) for any other necessary or proper reason.
8.2.3 We may require you to have a shower before you use the pool.
8.3 Licences to use the pool
8.3.1 You must not use the pool for private swimming lessons unless we have given you our written approval or a licence for that activity, or unless you are a parent or guardian teaching your child to swim.
8.3.2 We may grant a licence to swimming clubs or other clubs or organisations allowing the use of the pool for swimming, swimming sports, swimming lessons, or any other purpose.
8.3.3 We may impose any terms on a licence given under clause 8.3.1 or 8.3.2 which we think fit, and may charge a fee for the licence.
8.4 Who may use the swimming pool
8.4.1 Children under the age of eight may not enter the pool unless they are with a person who:
(a) is 14 years of age, or older; and
(b) is entitled to enter the swimming pool; and
(c) in the attendant's opinion, is capable of supervising that child in the swimming pool.
8.4.2 An attendant may refuse to allow or restrain you from entering the swimming pool if he or she reasonably believes that you may endanger your own health and safety or the health and safety of any other person in the swimming pool.
8.4.3 You may not enter or use a swimming pool:
(a) if you are intoxicated;
(b) if you are under the influence of drugs;
(c) if you are suffering from any communicable disease;
(d) if you are wearing any medical dressing, bandage, slicking plaster or other adhesive material;
(e) if you have not paid the entry fee to the attendant or produced a ticket allowing you to enter;
(f) at any time when the swimming pool is not open for use by the public;
(g) when the use for the pool is restricted to a portion of the public, and you are not within that portion of the public; or
(h) if you have had diarrhoea in the last 14 days.
8.4.4 You may not, within any part of a pool:
(a) use any indecent, obscene or insulting language;
(b) behave in an indecent, offensive, disorderly, or improper manner;
(c) smoke or use tobacco, chew gum or eat unless it is in a place we have authorised for those activities;
(d) write or draw on the walls of any building or accessories;
(e) interfere with any life-saving equipment;
(f) spit;
(g) use kickboards, flippers, snorkels, goggles or other swimming equipment unless you have consent from an attendant;
(h) dispose of litter unless it is in bins or receptacles provided for that purpose;
(i) use any substance that may discolour the pool or make it unfit for use by other pool users;
(j) foul or pollute the water;
(k) damage or destroy any article supplied for use in the pool;
(l) interfere with or remove any clothing or private property of any other person which is left in any part of the pool;
(m) run or indulge in boisterous or rough play, except supervised water sports;
(n) make any undue noise;
(o) damage any equipment used in connection with the pool;
(p) bring or have alcohol;
(q) allow a dog belonging to you, or under your control, to enter or remain;
(r) obstruct an attendant in the exercise of his or her duties;
(s) change a child's nappies unless you are in a changing room or toilet; or
(t) rinse off a child in the pool while you are changing their nappies.
8.5 Clothing
8.5.1 You must wear a swimming costume or other appropriate clothing at all times while you are in the swimming pool, except while you are in any changing room, toilet or shower.
8.5.2 If you are not wearing a swimming costume or other appropriate clothing, an attendant may ask you to change into a swimming costume or other appropriate clothing. If you do not comply with this request to the attendant's satisfaction, the attendant may ask you to immediately dress and leave the swimming pool.
8.5.3 If you find any articles or clothing left in a bathroom or changing room or in any other part of the swimming pool, you must deliver them to the attendant.
8.5.4 Children and incontinent persons must not wear nappies while they are in the swimming pool.
8.6 When we may ask you to leave the pool
8.6.1 You must leave the swimming pool immediately if an attendant requests all pool users to do so or if an alarm is sounded.
8.6.2 If an attendant believes that you have breached any requirement of this part of the Bylaw, he or she may:
(a) ask you to leave the pool immediately, and
(b) prohibit you from re-entering the pool for a period of time.
8.7 Hiring halls
8.7.1 We may, by resolution, determine Conditions of Hire for halls.
8.7.2 If you want to hire a hall you should:
(a) fill in and give us an application form, and
(b) pay us the application fee.
8.7.3 When we have received your application form and fee, we will either accept or decline your application.
8.7.4 If we accept your application, we will give you two copies of our Conditions of Hire to sign. We will keep one copy and give you the other copy.
8.7.5 If we decline your application, we will refund your application fee.
8.7.6 If you hire a hall from us you must:
(a) comply with all of the conditions set out in our Conditions of Hire;
(b) comply with Part 2 : Public Places of this Bylaw;
(c) be responsible for the actions and behaviour of those people using the hall during your period of hire; and
(d) if you intend to sell or consume any liquor, you must first obtain a special licence under the Sale of Liquor Act 1989. In this case the term "liquor" means any fermented, distilled or spiritous liquor (including spirits, wine, ale, beer, porter, honeymead, stout, cider and perry) that is found on analysis to contain 1.15% more alcohol by volume.
8.7.7 We can at any time vary or cancel our hire with you, on reasonable notice.
8.7.8 If you hire a hall from us and then cancel your hire:
(a) we will refund your application fee if you cancel your hire more than 7 days before the date you intended to use the hall;
(b) we will not refund your application fee if you cancel your hire less than 7 days before the date you intended to use the hall.
8.8 Takapuna Municipal Golf Course
8.8.1 You may not be on any part of the course unless you are playing golf, or accompanying a person playing golf. We may by resolution waive this restriction when there is an occasion on the course which we consider is of public interest.
8.8.2 We may, by publicly notified resolution, fix charges for playing golf on the course, and adopt rules for play. You must pay the appropriate charge before entering the course and play in the order that the course is laid out.
8.8.3 You will be in breach of this part of the Bylaw if you are on the course when under the age of 12 years unless accompanied by a person 18 years or older who is complying with the requirements of this part of the Bylaw.
8.8.4 If an officer requests you to leave the course you must leave the course immediately.
