Explanatory note: This part of the Bylaw restricts activities, which are likely to cause a nuisance, or adversely affect the health and safety of others. It confers powers on the Council to require a person to eliminate or reduce a nuisance, or prevent it occurring in the future.
7.1 Specific definition
Stock - Includes cattle, deer, donkeys, horses, sheep goats and pigs and includes stock intended for human consumption.
Urban - area Includes any area within the residential and business zones of the district plan.
7.2 Causing a nuisance on any premises
7.2.1 You must not create a state of affairs on any premises which is or which causes a nuisance.
7.3 Creating a state of affairs attracting vermin or pests
7.3.1 You must not create a state of affairs on any premises, which attracts or harbours vermin, flies, cockroaches, mosquitoes, or other pests.
7.4 Depositing or storing refuse or offensive matter
7.4.1 You must not deposit or store any refuse or offensive matter (excluding chemicals and contaminants) unless it is immediately incorporated into the earth or covered to prevent the escape of odours, liquid, dust, or the attraction of vermin, flies, cockroaches, wasps, mosquitoes or other pests.
7.5 Damaging or interfering with drains or infrastructure
7.5.1 You must not:
(a) Damage any drain, sewer, pumping equipment, or treatment plant or interfere with the treatment of any wastewater.
(b) Interfere with the free flow of any drain, sewer, stream, watercourse or other body of water except as authorised by a resource consent.
(c) Deposit any refuse or discharge any contaminant into any drain, sewer, stream, watercourse or other body of water except as authorised by a trade waste consent issued by us, a trade waste agreement with us, or a resource consent.
7.6 Vehicle likely to cause a nuisance
7.6.1 You must not leave a vehicle containing or which has recently contained refuse or offensive matter in a place where it is likely to cause a nuisance.
7.7 Maintenance of toilets, plumbing and drainage
7.7.1 You must keep any toilet, plumbing and drainage on any premises:
(a) In good working order; and
(b) in compliance with any requirements we have imposed.
7.8 Intruder alarms
7.8.1 You must not install or operate an intruder alarm system on any premises or on any vehicle parked on or within a premises unless:
(a) It is fitted with a control mechanism ensuring the alarm does not sound for longer than 10 minutes on a single occasion and does not reactivate unless manually reset.
(b) That in the case of an alarm fault the occupier has made appropriate arrangements to ensure that the alarm does not sound for longer than 10 minutes on a single occasion.
(c) The alarm is adequately maintained to minimise the likelihood of faults occurring and any faults that do occur are rectified when they come to attention.
7.8.2 We may contact the occupier of premises or the relevant security company or alarm service agent if an alarm sounds for longer than 10 minutes on a single occasion or is faulty.
7.8.3 We may charge you for any costs incurred where an alarm on premises occupied by you is required to be deactivated by us due to noise nuisance.
7.9 Dangerous fences
7.9.1 You must not put up, renew or repair a fence using barbed wire unless:
(a) The fence is in an urban area and is to prevent stock from straying from adjacent farmland, or the barbed wire is placed at least 2.5 metres above the ground; or
(b) The fence is in a rural area and more than 1.0 metre away from a public footpath.
We may require you to pull down or remove within a specified time a fence, which breaches this clause.
7.9.2 You must not put up, renew or repair a fence using an electrified wire unless:
(a) The fence complies with electrical installation and safety standards including specifications for barriers and warning signs as specified in AS/NZS 3016:1994 Electrical Installations – Electric Security Fences; or a subsequent standard.
(b) The fence is in a rural area and more than 1.0 metre away from a public footpath and complies with electrical installation and safety standards as specified in AS/NZS 3014:2003 Electrical Installations – Electric Fences or a subsequent standard.
7.9.3 You must not put up, renew or repair a fence using razor wire, unless you have written permission from us.
We may require you to pull down or remove within a specified time a fence, which breaches this clause.
7.10 Stock slaughter
7.10.1 You must not in an urban area slaughter stock or dismember, handle, process or dispose of the carcass or remains of an animal on any property or premise so as to be likely to cause a nuisance or a threat to public health or safety.
7.10.2 Clause 7.10.1 does not apply to a veterinarian registered under the Veterinarians Act 1994 or Government agencies authorised to carry out stock slaughter.
7.11 What we may require you to do
7.11.1 We may require you to do anything necessary to eliminate or reduce any nuisance or prevent it occurring in the future. This may include requiring that you:
(a) Abate any nuisance in any premises or yard.
(b) Remove or cover anything that is or causes a nuisance in breach of clause 7.4.
(c) Drain any stagnant or impure water, which has collected on any premises.
